General Terms and Conditions (GTC)
1. Scope of Application
The following General Terms and Conditions govern the contractual relationship between Christian Klemme (hereinafter referred to as the "Provider") and users of the website [www.daringsoul.one] (hereinafter referred to as "Customers") in connection with the purchase of e-books and other digital products, as well as the use of the services offered. Hereinafter, all digital products will collectively be referred to as "e-books."
2. Conclusion of Contract
The purchase contract is concluded once the Customer places an order via the website. By submitting the order, the Customer expressly declares their interest in purchasing the selected e-book and undertakes to pay the corresponding amount.
3. Prices and Payment Terms
The prices listed on the website are in Euros (EUR) and include the statutory value-added tax (VAT). Payment is processed through the payment service provider PayPal. The Customer agrees to complete the payment for the purchased e-book through the specified payment process.
4. Delivery and Access to the E-Book
Upon successful payment, the Customer will receive an email confirmation of their order. This confirmation includes a personal download link that grants direct access to the purchased e-book. The e-book is provided in electronic form as a standard PDF file. For video or audio products, an appropriate file format will be provided for download or streaming.
It is recommended that the Customer access and download the e-book within 24 hours of receiving the confirmation email to ensure smooth access. Should the Customer encounter any issues with downloading or accessing the e-book, our customer support team is available to assist and address any concerns.
The Customer is responsible for safeguarding and protecting the downloaded e-book. Unauthorized distribution or reproduction of the e-book without prior written consent from the author or publisher is strictly prohibited and constitutes a copyright violation.
We strive to provide our Customers with an optimal shopping experience and are available for any questions, feedback, or support inquiries. We hope the purchased e-book provides valuable insights and inspiration.
5. Right of Withdrawal
Since the purchased e-books are digital content, they fall under the category of goods that are not eligible for return due to their nature, in accordance with § 356 (5) of the German Civil Code (BGB). Consequently, there is no statutory right of withdrawal for digital content.
Upon completion of the purchase and receipt of the e-book, the Customer's right of withdrawal expires. The Customer is not entitled to request a refund or return after purchasing and downloading the e-book.
For membership subscriptions, the billing cycle begins at the start of each monthly payment interval. This means that upon payment, the Customer secures their membership benefits for the corresponding period.
We encourage Customers to carefully review the sample preview of the e-book before purchasing to ensure it meets their expectations and needs. We are confident that our e-books offer valuable information and inspiration and look forward to supporting our Customers in expanding their knowledge and perspectives.
6. Warranty and Liability
The Provider assumes no warranty for the accuracy, completeness, or timeliness of the information contained in the e-book. Use of the information is at the Customer's own risk. Any liability of the Provider for damages or consequential damages resulting from the use of the purchased e-books is excluded.
7. Data Protection
The collection, processing, and use of the Customer’s personal data are carried out in accordance with applicable data protection regulations. Further details can be found in our Privacy Policy.
8. Severability Clause
Should any provision of these General Terms and Conditions be or become invalid, the validity of the remaining provisions shall not be affected. In place of the invalid provision, a legally permissible regulation shall apply that best reflects the economic intent of the original provision.
